Jenny Tours – Tourist Tours

Waterkant 5c / in Migos Lounge, 9:00 am – 5:00 pm, Mon – Fri

General Terms and Conditions

This is an English translation for convenience; in case of any discrepancy, the Dutch version prevails.

1 In these terms, ‘arrangements’ means all services offered by Jenny Tours, or by third parties on behalf of Jenny Tours. In particular, the term arrangements includes the following services:

  • bus and/or air transport
  • boat transport
  • accommodation
  • meals
  • excursions
  • guidance by guides

2 In these terms, ‘travellers’ means the natural or legal person who purchases the service for themselves or on behalf of one or more travellers who, according to the client, must or may be regarded as a group.

3 Upon acceptance of the booking request, the client and/or traveller is liable for fulfilling all obligations arising for them from the travel agreement. Jenny Tours is likewise liable for fulfilling all obligations arising for it from the travel agreement, unless fulfilment cannot reasonably be required of Jenny Tours due to force majeure, such as natural disasters, political unrest and other forms of force majeure.

4 Jenny Tours' written confirmation of acceptance of the booking request, together with a first payment of at least 30% of the travel sum due under the travel agreement, is the client's and/or traveller's only proof that the agreement has been concluded. These terms form an integral part of the travel agreement. The balance of the travel sum must be paid to Jenny Tours no later than 5 working days before the day of departure, not counting the day of departure. If the client and/or traveller fails to pay the balance on time, Jenny Tours may cancel the booking and retain the first payment as compensation, subject to the provisions of article 9 of these terms. Administration costs are charged for payments by credit card, debit card and traveller's cheques.

5 The travel programme is set out in the itinerary provided by Jenny Tours to the client and/or traveller, unless otherwise agreed in writing. Jenny Tours is not responsible for the accuracy of information provided by third parties.

6 The published travel sum is per person based on double occupancy. If the traveller has paid a single supplement, the accommodation is based on one person per room.

7 Without prejudice to the provisions of these terms, Jenny Tours reserves the right to change the travel sum if it is partly determined by the prices of third-party services and that third party changes its prices. Jenny Tours will notify the client and/or traveller of such a change as soon as possible, and no later than 7 days before departure. The client and/or traveller then has the right to cancel the trip. Amounts already paid will be refunded without interest if the client and/or traveller notifies Jenny Tours of such a cancellation within 3 days of being informed of the price change.

8 The duration of the trip is stated in whole days, with the days of departure and arrival counted as whole days.

9 At departure and throughout the trip, the traveller must hold the necessary proof of inoculations and vaccinations.

10 Jenny Tours is not liable for the consequences of failing to obtain inoculations and vaccinations, and the client and traveller indemnify Jenny Tours in this respect.

11 When making the booking request, the client and/or traveller must provide a valid passport and/or proof of identity of the traveller.

12 If the client or traveller cancels a trip 21 to 30 days before departure, not including the day of departure, a penalty of 25% of the travel sum is due. For cancellations 10 to 20 days before departure, 50% of the travel sum is due. For cancellations less than 10 days before departure, the full travel sum is due.

13 Jenny Tours reserves the right to cancel the travel agreement without being liable for damages and without judicial intervention: (a) in the event of force majeure as referred to in article 3.

14 Jenny Tours must notify the client and/or traveller of a cancellation as referred to in article 13(a) as soon as possible. In all cases referred to in article 13, Jenny Tours must refund the travel sum received, without interest.

15 Jenny Tours is not liable for the consequences arising from photos, brochures and other information material provided about the trip or the itinerary.

16 The client and/or traveller must take out suitable travel, accident and cancellation insurance at their own expense.

17 Jenny Tours may change the itinerary because of cultural or weather conditions or for safety reasons.

18 If Jenny Tours is not the operator of the tour, the general terms and conditions of the operating party apply. These are provided to the client and/or traveller in writing by e-mail before the tour.

19 Jenny Tours may exclude a traveller who seriously misbehaves in any way from the trip or the remainder of it, without being liable for damages.

20 The traveller cannot hold Jenny Tours liable for damage resulting from limited means of communication, transport facilities, medical assistance and the adventurous nature of the trip.

21 If the trip is made by air, Jenny Tours is not liable for the traveller's damage resulting from delays in air transport provided by third parties where those delays constitute force majeure for those third parties.

22 If a trip has been booked for a group, the client is deemed to make the travel conditions known to all group members and indemnifies Jenny Tours against all damage in this respect.

23 These general terms and conditions, which cannot be changed by any employee, intermediary or agent of Jenny Tours, are governed exclusively by Surinamese law.
